Planning Permission and Frequently Asked Questions

Will I need planning permission to erect my garden building in my garden?

Typically, you won’t need to get permission for domestic outbuildings that are used for household-related purposes. However, there are certain circumstances where you might need to get planning permission. These include if you want to place the outbuilding within 5 meters of your house, if the total area of all buildings in your garden exceeds 50% of the total garden area, if there are restrictions from the original planning consent for your property, or if your property is in a designated area like a conservation area or an area of outstanding natural beauty. Additionally, if you plan to use the outbuilding for business purposes or if it is closer to a public highway than your existing house, you may need to seek permission. It’s always best to check with your local planning authority to be sure.

Is there any additional permission required?

If your property falls under historical protection or is located in a conservation area, it is important to obtain the necessary consent for any building work. In some instances, there may be restrictive agreements in place that restrict development in your backyard. It is recommended to check the property register at HM Land Registry for any such restrictions and seek approval from the relevant party. Your current planning permission may include conditions that limit your permitted development rights, which could also affect surrounding properties. It is advisable to consult with your local planning authority to clarify any restrictions. If you are uncertain about whether you require planning permission for building in your garden, it is wise to err on the side of caution and contact your local planning authority for guidance. They will be able to provide you with immediate clarification. Please note that the information provided in this notice is for guidance purposes only and we recommend seeking professional advice to ensure compliance with regulations.
